This Agreement outlines the terms and conditions under which All Seasons Car Rentals ("the Lessor" or "we") leases a vehicle to the Renter ("the Lessee" or "you"). By signing this contract, you agree to be bound by these terms.
1. Definitions
- "Vehicle": The motor vehicle, including all tires, tools, accessories, and documents, rented to the Lessee. The Lessee acknowledges that the Vehicle is the property of the Lessor.
- "Agreement": This document, the rental confirmation, and all related documents.
- "Authorized Driver(s)": The Lessee and any other individual(s) whose name(s) appear(s) on this Rental Contract and are authorized to operate the Vehicle.
2. Eligibility and Driver Requirements
- Minimum Age: The Lessee and all Authorized Drivers must be at least 25 years of age. Use of the Vehicle by a driver under 25 may void the insurance coverage.
- Valid License: A full and un-expired driver's license from the country of residence is required.
- Identification: A valid passport/ID and a major credit card in the Renter's name are required at pickup.
- Non-Transferable: This rental agreement is not transferable. Using the Vehicle without the written authorization of All Seasons Car Rentals is a violation of this contract.
3. Rental Period, Payment, and Charges
- Rental Basis: Days will be computed on a 24-hour basis, starting at the time written in this contract. Extra hours will be computed at an hourly rate.
- Rates: The Lessee agrees to pay the rental rate as set forth in this contract, including all applicable taxes and fees, such as the 12% Vehicle Hire Stamp Duty required by TCI law.
- Security Deposit: A security deposit will be pre-authorized on the Lessee's credit card to cover potential damages, late return fees, or other expenses.
- Fuel: Gasoline used and not replaced by the Lessee will be charged at current prevailing rates, specified here as $10/gallon.
- Authorization to Charge: The Lessee authorizes the Lessor to charge their credit card for all charges, including any fees incurred after the Vehicle's return (e.g., for damages, refueling, or traffic violations).
4. Vehicle Condition and Return
- Condition: The Lessee acknowledges delivery of the Vehicle free from damage except as specifically noted in this Rental Contract. The Lessee undertakes to return the Vehicle in the same condition as he received it.
- Lessor's Warranty: The Lessor leases the Vehicle to the Lessee in its present condition and to the Lessee's entire satisfaction. The Lessor makes no express or implied warranty as to any matter whatsoever, including the condition of the Vehicle or its fitness for any particular purpose.
- Return: The Vehicle must be returned to the agreed-upon location on the date and time specified. If the Lessee does not return the Vehicle at the specified time for any reason, the protection of the insurance will not be extended to the Lessee.
5. Use of the Vehicle
- Authorized Use: The Vehicle will be driven only by the Lessee or by the Authorized Driver(s) whose name(s) appear(s) on this Rental Contract.
- Prohibited Uses: The Lessee agrees that the Vehicle will not be:
- Driven by anyone under the influence of alcohol or drugs.
- Driven in an illegal, reckless, or otherwise abusive manner, or in violation of any law or traffic regulation.
- Used to propel or to tow any other vehicle or device.
- Used for any illicit trade or transportation, or for carrying passengers for hire.
- Driven on beaches, off-road, or in any manner hazardous to public safety.
- Odometer Tampering: If the odometer is damaged by the Lessee, they must immediately report it to the Lessor. If this is not done, or if the odometer has been tampered with, the Lessee will be charged for mileage based on an average of 200 miles per day of rental.
6. Insurance, Liability, and Accidents
- Insurance Coverage: Any violation of this rental contract may void the insurance coverage.
- Damage Liability: The Lessee agrees to pay the Lessor for any damage to the Vehicle from any cause, unless the Lessee initials and pays for the optional Collision Damage Waiver (CDW). The CDW deductible is $500.00.
- CDW Limitations: The Collision Damage Waiver is not insurance and is null and void if the rental agreement is breached. The CDW does not cover collision damage to glass, tires and rims, transmission, and engine. The Lessee is always fully liable for damage to these parts. The Lessee is also fully liable for the car if it is stolen or damaged by reason of abuse, Act of God, fire, gross negligence, or vandalism.
- Loss of Use: The Lessee is fully liable for all claims for "down time/loss of use" for up to thirty (30) days.
- Accidents & Defects: The Lessee undertakes to immediately advise the Lessor by telephone of any mechanical defect which interferes with the safe operation of the Vehicle and to cease operating it. The Lessee must also immediately report any theft or accident to the Police and the Lessor within 24 hours. The Lessee shall fully cooperate with the Lessor's insurers in any investigation or defense of a claim or suit.
7. Indemnity and Legal Fees
- Indemnity: The Lessee shall at all times hold the Lessor harmless against all claims, suits, and actions arising out of the Lessee's renting or operation of the Vehicle.
- No Lessor Responsibility: It is agreed that the Lessor is not responsible for injuries sustained by the Lessee, driver(s), or passenger(s), including injuries which may arise out of the sole negligence of the Lessor.
- Legal Costs: If the Lessor employs an attorney or a collection agency to enforce any part of this Rental Contract, the amount of the claim against the Lessee will be increased.
I, the Lessee, acknowledge that I have read, understood, and agree to the terms and conditions of this Rental Agreement. I confirm that all information provided is accurate and that I have received the Vehicle to my entire satisfaction.
