All Seasons Car Rental

This Agreement outlines the terms and conditions under which All Seasons Car Rental (“the Lessor” or “we”) leases a vehicle to the Renter (“the Lessee” or “you”). By signing this contract, you agree to be bound by all terms contained herein.

1. Definitions

  • “Vehicle”: The specific motor vehicle leased to you, including all tires, tools, accessories, and documents. The Lessee acknowledges that the Vehicle is the property of the Lessor.
  • “Agreement”: This document, the rental confirmation summary, and all related addenda.
  • “Authorized Driver(s)”: The Lessee and any other individual(s) whose name(s) appear(s) on this Rental Agreement and are authorized by the Lessor to operate the Vehicle.

2. Eligibility and Driver Requirements

  • Minimum Age: The Lessee and all Authorized Drivers must be at least 25 years of age. Use of the Vehicle by a driver under 25 may void all insurance coverage.
  • Valid License: A full, valid, and unexpired driver’s license from the country of residence, held for at least one year, is required.
  • Identification: A valid passport or government-issued ID and a major credit card in the Renter’s name are required at the time of pick-up.
  • Non-Transferable: This rental agreement is not transferable. Allowing any person not listed as an Authorized Driver to operate the Vehicle is a material breach of this contract.

3. Rental Period, Payment, and Charges

  • Rental Basis: Rental days are computed on a 24-hour basis, starting at the time specified in this contract. Extra hours will be computed at the specified hourly rate.
  • Rates: You agree to pay the rental rate as outlined in this contract, including all applicable taxes and fees, such as the 12% Vehicle Hire Stamp Duty required by Turks and Caicos Islands law.
  • Security Deposit: A security deposit will be pre-authorized on your credit card to cover potential damages, late return fees, refueling charges, or other expenses.
  • Fuel Policy: The Vehicle is provided with a full tank of fuel. You must return it with a full tank. Gasoline used and not replaced by the Lessee will be charged at the prevailing rate of USD 10.00 per gallon.
  • Authorization to Charge: You expressly authorize the Lessor to charge your credit card for all charges related to this rental, including any fees incurred after the Vehicle’s return (e.g., for damages, refueling, parking fines, or traffic violations).

4. Vehicle Condition and Return

  • Condition at Delivery: You acknowledge receiving the Vehicle free from damage except as specifically noted on the vehicle condition report in this Rental Agreement. You undertake to return the Vehicle in the same condition as you received it, accounting for normal wear and tear.
  • Lessor’s Warranty Disclaimer: The Lessor leases the Vehicle “as is.” The Lessor makes no express or implied warranty as to any matter whatsoever, including the condition of the Vehicle or its fitness for any particular purpose.
  • Vehicle Return: The Vehicle must be returned to the agreed-upon location on the date and time specified. If you do not return the Vehicle at the specified time, insurance protection may be voided.

5. Use of the Vehicle

  • Driving in Turks & Caicos: For your safety, please remember to DRIVE ON THE LEFT-HAND SIDE OF THE ROAD and navigate roundabouts with caution.
  • Authorized Use: The Vehicle will be driven only by the Lessee or by the Authorized Driver(s).
  • Prohibited Uses: The Lessee agrees that the Vehicle will NOT be:
    • Driven by anyone under the influence of alcohol or drugs.
    • Driven in an illegal, reckless, or otherwise abusive manner.
    • Used to propel or tow any other vehicle or device.
    • Used for any illicit trade or transportation, or for carrying passengers for hire.
    • Driven on beaches, off-road, or in any other hazardous manner.
  • Odometer Tampering: If the odometer is damaged or fails, you must immediately report it to the Lessor. If you fail to do so or if the odometer has been tampered with, you will be charged for mileage based on an average of 200 miles per day of rental.

6. Insurance, Liability, and Accidents

  • Insurance Coverage: Any violation of this Rental Agreement may void your insurance coverage.
  • Damage Liability: The Lessee agrees to pay the Lessor for any damage to the Vehicle from any cause. This liability may be limited if you accept and pay for the optional Collision Damage Waiver (CDW). The CDW has a deductible of USD 500.00.
  • CDW Limitations: The CDW is not insurance and is null and void if the rental agreement is breached. The CDW does not cover collision damage to glass (windshields), tires, rims, transmission, or the engine. The Lessee is always fully liable for damage to these parts. The Lessee is also fully liable for the full value of the car if it is stolen or damaged by reason of abuse, an Act of God, fire, gross negligence, or vandalism.
  • Loss of Use: The Lessee is fully liable for all claims for “downtime/loss of use” for up to thirty (30) days while the vehicle is being repaired.
  • Accidents & Defects: You must immediately report any accident, theft, or mechanical defect to the Police (911) and to the Lessor. You must cease operating the Vehicle if it is unsafe. You shall fully cooperate with the Lessor and our insurers in any investigation or defense of a claim or suit.

7. Indemnity and Legal Fees

  • Indemnity: The Lessee shall defend, indemnify, and hold the Lessor harmless against all claims, suits, and actions arising out of your renting or operation of the Vehicle.
  • No Lessor Responsibility: It is agreed that the Lessor is not responsible for injuries sustained by the Lessee, driver(s), or passenger(s), even if such injuries arise out of the sole negligence of the Lessor.
  • Legal Costs: If the Lessor employs an attorney or a collection agency to enforce any part of this Rental Agreement, the amount of the claim against the Lessee will be increased to include all reasonable attorney’s fees and collection costs.
